Through its acceptance, the User declares that they have read and understood what is stated here and that they are aware of their rights, Mood by Jay's purchase policies, conditions, and warranties, as well as their obligations and general conditions of access and use of the websites referenced above. If the User does not agree with the content of this document, they must leave this website, not being able to access or dispose of the services it offers. Likewise, the User expressly and without exception accepts that the access and use of this website, its services, and the contents of said services take place under the sole and exclusive responsibility of the User.

The User of the website implies the complete acceptance without reservations of each and every resolution included in this Terms and Conditions. Therefore, the user must read the current legal notice carefully every time the website is accessed, as the terms of use are subject to modifications on the judgment of the website's owner, or due to legal, judicial criteria, or business practice changes.

 Please read these Terms and Conditions carefully before placing an order. These conditions apply to all accessory purchases.

  1. Accepting orders

 A binding contract is created between Mood by Jay and the User when the order is accepted. The User will receive an order confirmation e-mail once the purchase is complete, the order number will be provided there.

Please ensure that the details you provide us are correct and complete. Please ensure that you enter the correct delivery address format into the appropriate fields. Postal or Zip codes must be used where the delivery address format contains one.

 Please note that as our team is constantly making efforts to get your order dispatched as quickly as possible, we may not be able to cancel your order or change an item/shipping address upon request.

 Mood by Jay will not take responsibility for incorrectly entered, missing or inaccurate information in the delivery address fields. Please check the details you have entered in the address fields.

 No refunds or duplicate dispatches will be issued if Mood by Jay is not informed of any address format changes before dispatch of the original order.

 Mood by Jay reserves the right to cancel an order at any given time without any explicit reasoning.

  2. Preparation Time

 

All orders are prepared within 2 - 3 business days as of the order confirmation date. This preparation time can vary according to peak season, for example Black Friday or Christmas.

Orders are prepared quickly, and so, changes upon customer request cannot be guaranteed.

However, the customer can contact our Customer Service team, who will do its best to accommodate the customer's request.

 After an order is dispatched, a confirmation email is sent, from which the customer can track their order. Information may take some time to be updated on the tracking link.

Order preparation time may be subject to exceptional circumstances.

 

3. Delivery

 Delivery times will depend on where you are located, our shipping partners and the service of your choice. Mood by Jay is making an effort to improve the shipping options for our customers, please check the website’s FAQs for up-to-date information.

Delivery time refers to the amount of days between the collection of the package from our warehouse and the first delivery attempt. This does not account for the order preparation time, additional delivery attempts, or the date or days available at a carrier pick-up point.

 Please note that delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such. As we process your order, we will inform you by email if any products you order turn out to be unavailable or if there are any delays in the order process.

Signature will not be required upon delivery on any of our shipping services. USPS, FedEx or UPS will deliver the package at the delivery address provided, and it may be received anyone present at the address at the moment of delivery.

 In the event of a purchased item not being inside the package you received, our claims process will be implemented. This means our support representative will ask for a signed and dated statement. For a “Item not received” claim to be approved, this statement must be sent to our support team within the first week after receiving your purchase.

We cannot guarantee any assistance on claims for orders not received nor on claims for items not received if these claims are received more than one week after the order has been delivered. These issues are time-sensitive as all logistics partners who handled the package must be contacted. Tracking and fulfillment information must be checked as quickly as possible to assess the missing package or item.

 

4. Discounts

Percentage discounts cannot be stacked and used simultaneously with others. Only one discount can be applied to a single order.

 Mood by Jay reserves the right to modify its prices at any time as long as we guarantee to the buyer the application of the current price at the moment of the order confirmation. Mood by Jay will not be obliged to compensate the customer after the date of purchase.

 Mood by Jay will not bring back conditions offered during the sale periods if the purchase was not completed during the sale.

To take advantage of the 15% First Purchase discount, the customer must subscribe to the Mood by Jay newsletter. Following this, the customer will receive the discount code via email. It is not possible to use the code if a purchase was already made on our website. The discount code cannot be applied to any purchase following confirmation on our system.

 Buy X Get Y promotions are binding. A percentage discount will be applied on all products included the User’s cart.

Promotions available on the website, either via discount code, product discounts or automatically discounts applied to the User’s cart may be subject to change – Mood by Jay is not obligated to honor promotions or deals that may have been previously visible o Mood by Jay's website, on paid media ads or anywhere else on the internet or other forms of media if that ad/campaign has expired.

 

5. Payments & Security

Mood by Jay offers several payment methods to the customer. All those methods are securely encrypted. We cannot see, nor store the customer's information.

The online payment methods offered are shown during the checkout process.

Those methods also ensure that no piece of information can be used by any disinterested party, as they are based on protected algorithms, transmitting encrypted information, so that it is only visible for bank entities.

Mood by Jay is not responsible nor will cover for any hidden fees, exchange fees, payment processing fees or any other extra charges applied either by the payment provider or the customer’s bank. 

 

6. Returns & Refunds

At Mood by Jay, all sales are final. However, as a Mood by Jay client, you are entitled to a store credit/exchange in the event of damaged items. Notification of the defective product should made within the first 30 days after receiving your items. The date which the items are deemed to have been received is based on the information which we are provided by the shipping companies.

Please be sure to verify size, weight, color, material prior to purchase to ensure that you are satisfied with your items.  

Mood by Jay will not be held accountable for lost packages or any problems that may happen during the return transportation.

 Please note that processing the return once it is received may take up to 5 business days. You will receive an email once the exchange or refund has been processed.

If you receive a proven defective piece, we will be able to provide store credit in its value, so you can get a replacement 100% free. Please reach out to our customer support: contactmoodbyjay@gmail.com 

Otherwise explicitly informed on the website, returns are not free. Any additional services are subject to Mood by Jay's review at any moment.  

 

 

7. Breakage Warranty

 All our jewelry has a 6-month quality warranty, starting from the delivery date of the order.

 To enquire to see if your item meets the requirements of the Breakage Warranty, please contact our Customer Support Team using the email address: contactmoodbyjay@gmail.com

To be able to activate the warranty, it is mandatory provide photos or videos showing the breakage issue on the item.

 In order for us to assess whether the item meets the requirements of the warranty, it is mandatory that you provide photos or videos showing broken item. If our team is able to verify the issue, either a store credit/discount code with the item value will be provided or a replacement for the item.

 If the items are broken after a 6-month period after you received you order, we will not be responsible for their replacement or repair.

 We are not responsible for lost or stolen items.

 Mood by Jay, is not responsible for allergic reactions caused for one of our items. Our jewelry is made alloy, titanium, copper and stainless steel. Descriptions are listed on each product. Please read and consider any possible allergies you may have prior to purchase. PVD coating may a very small percentage of nickel. We receive lots of feedback from our customers saying they're allergic to nickel, but they haven't developed any symptoms, we still cannot guarantee you will react in the same way.

 8. Access to Mood by Jay Shop.

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. We have taken reasonable care to ensure the accuracy of the content on our website, however, in accordance with the applicable laws, we disclaim all warranties (express or implied) as to the accuracy of the information contained in any of the material on our site.
